Berkeley Blvd., LLC (“Berkeley Blvd.,” “we,” “us,” or “our”) respects your privacy and is committed to protecting it. This Privacy Policy explains what personal information we collect through https://berkeleyblvd.com (the “Site”) and in the course of providing our services, how and why we use it, when and with whom we share it, how we protect it, and the rights and choices you have. By using the Site or our services, you agree to this Policy. We do not sell your personal information.
1. Who this Policy applies to
This Policy applies to visitors to the Site, prospective clients who contact us, and clients who engage our services. Where we process personal information on behalf of a client as part of a project (for example, data within a system we build for you), we do so under that client’s instructions and the applicable agreement, and the client is the controller of that data.
2. Information we collect
We collect the following categories of information:
- Information you give us. When you submit the contact form, request a proposal, or correspond with us, we collect your name, email address, company, and the contents of your message. During an engagement, we receive the materials, content, credentials, and account access you choose to share.
- Billing information. When you pay us, our payment processor collects your payment method and billing details. We retain limited records as described in Section 4.
- Usage and device information. When you visit the Site, we may automatically collect limited technical information such as IP address (often only briefly), browser type, device type, pages viewed, referring page, and approximate region, used in aggregate to operate and improve the Site.
- Communications and recordings. We keep records of our correspondence. With your consent, video or call meetings may be recorded or transcribed for note-taking and to share internally among our team.
3. Information we do not collect
We do not intentionally collect sensitive personal information such as government identifiers, health data, biometric data, precise geolocation, or protected characteristics (e.g., race, religion, sexual orientation), and we ask that you not send such information to us unless it is strictly necessary for an engagement and we have agreed in writing on appropriate safeguards.
4. Payment processing
Payments are handled by Stripe, Inc. through our secure client billing portal. Your full card and bank details are transmitted directly to Stripe and never pass through or get stored on our servers. We retain only limited billing records, such as the last four digits of your card, your billing address, and invoice and transaction history, to provide our services, calculate and remit tax, detect and prevent fraud, and meet our accounting and legal obligations. Stripe processes your information as an independent controller and/or our processor under Stripe’s own privacy policy, which we encourage you to review.
5. Cookies and analytics
We use a limited set of cookies and similar technologies to operate the Site and to understand usage in aggregate through privacy-respecting analytics. Strictly necessary cookies are required for the Site to function; analytics cookies help us measure traffic and improve the experience. You can control or disable cookies through your browser settings, though some features may not work properly without them. We honor recognized browser-based opt-out signals where required by law.
6. How we use information
- To respond to your inquiries, provide proposals, and deliver and improve our services and Deliverables;
- To process payments, issue invoices, calculate tax, and prevent fraud;
- To operate, maintain, secure, and improve the Site and our internal operations;
- To communicate with you about your engagement, including service and administrative messages;
- To send you marketing communications where permitted (you can opt out at any time); and
- To comply with our legal, tax, and accounting obligations and to establish, exercise, or defend legal claims.
7. Legal bases for processing
Where the GDPR or similar laws apply, we rely on the following legal bases: performance of a contract with you; our legitimate interests in operating and improving our business (balanced against your rights); your consent (which you may withdraw at any time, for example for marketing or recordings); and compliance with our legal obligations.
8. When we share information
We share personal information only as needed to run our business:
- Service providers (subprocessors). Trusted vendors who help us operate, such as Stripe for payments, our hosting and infrastructure providers, analytics tools, and email and communication tools, each only to the extent needed to perform their function and under obligations of confidentiality and data protection.
- Professional advisors. Our accountants, auditors, and lawyers, where necessary.
- Legal and safety. When required by applicable law, regulation, subpoena, warrant, or court order, or to protect the rights, property, or safety of Berkeley Blvd., our clients, or others. Unless legally prohibited, we will aim to notify you of legally compelled requests for your information.
- Business transfers. In connection with a merger, acquisition, financing, or sale of all or part of our business, subject to this Policy.
We do not sell your personal information, and we do not share it for cross-context behavioral advertising.
9. Data retention
We keep personal information only as long as needed for the purposes described in this Policy or as required by law. For example, billing, invoicing, and tax records are retained for the period required by applicable accounting and tax rules; contact and correspondence records are kept while we have or pursue a relationship and for a reasonable period afterward; and analytics data is kept in aggregate. When information is no longer needed, we delete or anonymize it.
10. Data security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. Data is encrypted in transit using SSL/TLS, access is limited to those who need it, and we maintain backups. No method of transmission or storage is completely secure, however, so we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will notify you and any regulators as required by applicable law.
11. Your rights and choices
Depending on where you live, you may have some or all of the following rights with respect to your personal information. We extend these core rights to all of our users where practical, regardless of location:
- Access & know: request confirmation of and access to the information we hold about you and how we use it;
- Correction: request that we correct inaccurate or incomplete information;
- Deletion / erasure: request that we delete your information, subject to legal retention requirements;
- Restriction & objection: ask us to restrict or object to certain processing, including objecting to direct marketing;
- Portability: receive a copy of certain information in a portable format;
- Withdraw consent: withdraw any consent you previously gave, without affecting prior lawful processing;
- Non-discrimination: we will not deny services, charge different prices, or provide a different quality of service because you exercised your privacy rights;
- Complain: lodge a complaint with your local data-protection authority or supervisory authority.

12. U.S. state privacy rights
If you are a resident of California or another U.S. state with a comprehensive privacy law, you have the rights described in Section 11 to the extent that law applies, including the right to know, access, correct, and delete your personal information and the right to opt out of any “sale” or “sharing” of personal information. 13. International transfers
We operate in the United States, and our service providers may be located in the United States or other countries. If you access the Site or engage us from outside the United States, you understand and agree that your information may be transferred to, stored in, and processed in the United States and other jurisdictions, where data-protection laws may differ from those in your country. Where required, we use appropriate safeguards (such as standard contractual clauses) for such transfers.
14. Third-party links
The Site and our communications may contain links to third-party websites and services that we do not control and whose privacy practices are governed by their own policies. We are not responsible for those third parties, and we encourage you to review their policies.
15. Children’s privacy
The Site and our services are intended for businesses and are not directed to children under 13 (or the minimum age in your jurisdiction). We do not knowingly collect personal information from children. If you believe a child has provided us personal information, please contact us and we will delete it.
16. Changes to this Policy
We may update this Policy from time to time to reflect changes in our practices or the law. The “last updated” date above reflects the current version, and material changes will be posted on this page and, where appropriate, communicated to you.
